It depends.. The driver does not touch any TX power related configuration unless specificly asked to with 'iwconfig wlan0 txpower <val>'. I would assume that most card manufacturers use near to the maximum values for this, but at least the cards I have used do not seem to set this to the exact maximum.
I do not know whether there is really a noticeable difference in the output power in some cards. Anyway, I was able to increase the signal levels a station got from the AP on some tests with this.
